Mengikut Seksyen 73(1) ISA, perintah penahanan dibuat oleh pihak polis. Pihak yang ditahan akan disimpan di satu tempat misteri selama 59 hari. Dalam tempoh itu, dia akan menjalani soal-siasat yang intensif. Dia tidak akan diizinkan menemui sesiapa waima keluarganya. Pada hari ke-60, dia akan berhadapan dengan dua kemungkinan. Satu, akan dibebaskan. Kedua, pihak polis akan mendapatkan keizinan Menteri Dalam Negeri untuk terus menahannya selama dua tahun, tanpa bicara. ----------
Mengikut Seksyen 8(1), arahan penahanan dibuat oleh Menteri Dalam Negeri. Pihak yang ditahan akan terus disimpan di Penjara Kemunting. Dia tidak akan menjalani apa-apa soal-siasat intensif. Dia hanya diberikan cuti paksa selama dua tahun.
